AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO ANNEXING CERTAIN
LANDS TO BE INCLUDED WITHIN THE BOUNDARIES OF THE CITY OF
CHUBBUCK, ~ND EXCLUDING CERTAIN LANDS FROM THE BOUNDARIES
OF THE CITY OF CHUBBUCK. THIS ORDINANCE IS FOR THE PURPOSE
OF CORRECTING ORDINANCE NO. 103 WHICH CONTAINED AN ERRONEOUS
DESCRIPTION OF LAND INTENDED TO BE EXCLUDED FROM THE BOUNDARIES
OF THE CITY OF CHUBBUCK.
It appearing to the Mayor and City Council of the City
of Chubbuck, Idaho, that a portion of the land described by
Ordinance No. 103 of said City, was erroneously and mistakenly
described so as to exclude certain lands from the boundaries
of the City of Chubbuck which were not intended to be ex-
cluded; in order to correct this mistake and to carry out the
intentions of the Mayor and City Council with respect to the
actual and true description of the lands intended to be ex-
cluded, this Ordinance No. 117 is hereby passed.
It further appearing that Ordinance No. 117, passed and
approved the 26%hday of December, 1972, contained a typo-
graphical error in the lands intended to be excluded, therefore,
Ordinance No. 117 is reenacted to eliminate said typographical
error and contain a correct description of said land.
BE IT OP~AINED BY THE Mayor and city Council of the City
of Chubbuck, Idaho, that the following described lands be,
and the same are hereby annexed and included within the
boundaries of the City of Chubbuck and are made a part of
the jurisdictional limits of the City of Chubbuck:
Beginning at a point on the North boundary of the
Southwest 1/4 of said Section 2, midway between the
East boundary and the West boundary of said section;
thence r~nning South along said line to a point 340
feet North of the South boundary of the Southwest 1/4
of the said section; thence running West to the
Easterly boundary of the right of way of the Fort Hall
Main Canal; thence running North along the East boun-
dary'of the Fort~Hall Main Canal to the North boundary
line of the Southwest 1/4 of said section; thence
running East along said North boundary line to the
point of beginning.
BE IT FURTHER ORDAINED BY THE Mayor and City Council
of the City of Chubbuck, Idaho, that the following described
lands be, and the same are hereby excluded from the boundaries
of the City of Chubbuck, and are no longer a part of the
jurisdictional limits of the City of Chubbuck:
Commencing at the West/~./~6~C~orner on the South
line of section 2, Tow~r~ 6 South, Range 34
E.B.M., Bannock County, Idaho; thence North 1°
34' West along the West 1/16 line of said Section
2 (Two), 669~42 feet, to the Point of Beginning.;
THENCE NORTH 89° 48' WEST 448.08 FEET MORE OR LESS
TO THE CENTER LINE OF THE FORT HALL MAIN CANAL;
thence following the center of the Fort Hall Main
Canal, North 3° 39' West 100 feet; thence o
37' East 484.5 feet; thence West 5° 52' .8
feet; thence North 12° 37' Ea~372 feet; thence
North O° 51' East 422.6 feet; thence North 42° 47'
West 117.0 feet; thence North 30° 06' West 107.2 feet;
thence North 16° 28' West 109.5 feet; thence North
11° 19' west i44.9 feet; thence North 8° 15' East
50 feet, more or less, to the North boundary of the
Southwest Quarter; thence East to the West 1/16
corner on the latitudinal centerline; thence South
2000 feet to the Southeast corner of subject property
AND THE POINT OF BEGINNING.
The above described tract of land is a part of the
Southwest Quarter of Section 2, Township 6 South,
Range 34 E.B.M., and contains 20 acres, more or
less, of which approximately 5.34 acres is occupied
by the Fort Hall Main Canal and right-of-way for a
road which is 0.24 acres of highway.
The same being the lands owned by Gary H. Carlsen.
An emergency is hereby declared to exist and this
Ordinance shall be in full force and effect immediately
upon its passage and approval and publication as required
by law.

COUNCIL OF THE CITY OF CHUBBUCK, IDAHO, THIS ~3~d day of
