HomeMy WebLinkAbout0121 Zoning Fort Hall Main Canal 1973ORDINANCE NO. 121 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR CERTAIN LANDS AND PROPERTY WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK TO BE RE-ZONED AND CHANGED FROM ZONE AT (AGRICUL- TURAL TR~SITIONAL) TO ZONE R-2L (RESIDENTIAL 2, LIVESTOCK PERMITTED); PROVIDING FOR TH~S ORDINANCE TO BE IN EFFECT ON ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW, THE RULE REQUIRING ORDINANCES TO BE READ ON THREE SEPARATE DAYS ~AVING BEEN DISPENSED WITH. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CHUBBUCK, IDAHO: Section 1. That the real property described as: Commencing at the west 1/16 corner on the south line of Section 2, T. 6 S., R. 34 E., B.M. thence N. l°34' West along the west 1/16 line on the said Section 2, 464.42 feet to the point of beginning; thence S. 89°48' W. 442.47 feet to the centerline of the Fort Hall Main Canal, thence northerly along the said centerline 205 feet, thence N. 89"48' E. 448.08 feet to the aforesaid west 1/16 line thence S. 1'34' E. 204.9 feet to the point of beginning. the same being property owned by Francisco A. Cuoio, is hereby re-zoned and changed from Zone AT (Agricultural Transitional) to Zone R-2L (Residential 2, Livestock permitted). Section 2. That the real property described as: Commencing at the West 1/16 corner of the South Line of Section 2, T. 6 S., R. 34 E., B.M., thence north along the West 1/16 Line 164.76 feet to point of beginning; thence continuing north 299.66 feet; thence S. 89°48' West, 342.47 feet; thence 53°49' East, 300 feet thence North 89'48' East, 330.77 feet to the point of beginning. Same being a tract of land in the SE 1/4 SW 1/4 SW 1/4 Section 2, T. 6 S., R. 34 E., B.M., Bannock County, Idaho, excepting therefrom the right of way for Hayfield Airport Road as described in deed recorded in Book 106, at Page 513, Records of Bannock County Idaho. the same being property owned by Ross C. Kelly, is hereby re- zoned and changed from Zone AT(Agricultural Transitional) to Zone R-2L (Residential 2, Livestock permitted). Section 3. This Ordinance shall become effective upon its passage, approval and publication as provided by law, the rule requiring reading on three separate days having been dispensed with.
