HomeMy WebLinkAbout0132 Zoning 1973ORDINANCE NO. 132 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR CERTAIN LANDS AND PROPERTY WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK O~NED BY LAND INVESTMENTS, INC., TO BE RE-ZONED AND CHANGED FROM AGRICULTURAL TRANSITIONAL TO R-2T (MOBILE HOME); PROVIDING FOR CERTAIN LANDS AND PROPERTY WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK OWNED BY TRIANGLE INVESTMENT, INC., TO BE RE-ZONED AND CHANGED FROM AGRICULTURAL TRANSITIONAL TO R-1 (SINGLE- FAMILY RESIDENTIAL) ; PROVIDING FOR CERTAIN LANDS AND PROPERTY WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK OWNED BY NEWELL TURNER TO BE RE-ZONED AND CHANGED FROM AGRICULTURAL TRANSITIONAL AND R-2 (COMBINED RESIDENTIAL) TO R-2 (COMBINED RESIDENTIAL) ; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE ~.~AYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: That the following described lands and property within the boundaries of the City of Chubbuck, Idaho, owned by Land Investments, Inc., be re-zoned and changed from Agricultural Transitional to R-2T (Mobile Home): A tract of land partially in the W1/2 NWl/4 of Section 11, and partially in the El/2 NE1/4 of Section 10, all in Township 6 South, Range 34 E.B.M., and more fully described as follows: Beginning at point of intersection of the South line of Mobile Manor, a Subdivision in the above described Sections 10 and 11, and the center line of Whitaker Road, which point is South 01036' a distance of 625.00 feet from the northeast corner of said Section 10; thence North 89°48' East along the South line of said Mobile Manor a distance of 736.48 feet, more or less, to the westerly right of way line of Hiline Road; thence South 00o55' West "on records as South 00°57' West" along the said westerly right of way line of said road a distance of 85.42 feet; thence Southeasterly along the said westerly right of way line on a curve to the left with a radius of 1934.86 feet, for a distance of 271.64 feet; thence North 89°47'50'' West a distance of 1090.0 feet, more or less~ thence North 322.0 feet; thence East 205.0 feet to the southeast corner of Mobile Manor Subdivision; thence easterly along the southern boundary of Mobile Manor Subdivision a distance of 125.0 feet; thence North l°16' West 35.3 feet to the point of beginning. SECTION 2: That the following described lands and property within the boundaries of the City of Chubbuck, Idaho, owned by Triangle Investment, Inc., be re-zoned and changed from Agricultural Transitional to R-1 (~ingle-Family Residential): Commencing at a point that is S O Degrees 01'04" East, 25 feet and S 89 Degrees 54'10" East, 899.0 feet from the NW Corner of the NE1/4 of the NWl/4 of Section 11, T.6S., R34E, B.M. Bannock County, Idaho and thence S89 Degrees 54'10"E 414.5 feet; thence S 0 Degrees 01'04" E 729.0 feet; thence N89 Degrees 54'10" W 729.5 feet~ thence N 0 Degrees 01'04" W 554.0 feet; thence S 89 Degrees 54'10" E 315.0 feet; thence N 0 Degrees 01'04" W 175.0 feet to the point of beginning. SECTION 3: That the following described lands and property within the boundaries of the City of Chubbuck, Idaho, i!consisting of two parcels owned by Newell Turner, be re-zoned and changed from a mixture of Agricultural Transitional and R-2 (Combined Residential) to R-2 (Combined Residential) entirely: Commencing at the northwest corner of the NE1/4 NWl/4 of Section 11, Township 6 South, Range 34 East Boise Meridian, Bannock County, Idaho, and running thence south along the west line of said NE1/4 NWl/4 for a distance of 25 feet to the point of beginning of this survey, continuing thence south along said line for a distance of 290 feet; thence east parallel to the north line of said NE1/4 NWl/4 for a distance of 400 feet; thence north parallel to the west line of said NE1/4 NWl/4 for a distance of 290 feet; thence west parallel to the north line of said NE1/4 NWl/4 for a distance of 400 feet to the point of beginning. A parcel of land in the NE1/4 NWl/4 Section 11, Town- ship 6 South, Range 34 East, Boise Meridian, Bannock County, Idaho, more particularly described as follows: Beginning at a point on the west 1/16 line of Section 11, Township 6 South, Range 34 East, Boise Meridian, said point being 315.00 feet southerly from said west corner; thence south along the west 1/16 line of said Secti6n~ll, 272.25 feet; thence easterly parallel to the north line of said Section 11, 400.00 feet; thence northerly parallel to the west 1/16 line of said Section 11, 272.25 feet~ thence westerly parallel to the north line of said Section 11, 400.00 feet, more or less, to the point of beginning. SECTION 4: That the rule requiring ordinances to read on three separate days is hereby dispensed with, and ll!ithls' ordinance shall become effective upon its approval and .publication as provided by law. SECTION 5: Effective date. That the rule requiring an ordinance to be read on three separate days is hereby dispensed l!with, and this ordinance shall become effective upon its approval and publication as provided by law.
