AN ORDINANCE RELATING TO THE JOINT WATER AND
SEWER SYSTEM OF THE CITY OF CHUBBUCK, IDAHO;
PROVIDING FOR A SPECIAL ELECTION AT WHICH
THERE SHALL BE SUBMITTED TO THE ELECTORS
QUALIFIED TO VOTE THEREON THE QUESTIONS OF
ISSUING GENERAL OBLIGATION WATER AND SEWER
BONDS AND OF ISSUING JOINT WATER AND SEWER
REVENUE BONDS OF THE CITY FOR THE PURPOSE OF
DEFRAYING IN PART THE COST OF CONSTRUCTING A
SEWERAGE SYSTEM AND IMPROVING, EXTENDING AND
BETTERING THE PRESENT MUNICIPAL WATER SYSTEM;
PRESCRIBING DETAILS IN CONNECTION THEREWITH;
RATIFYING ACTION PREVIOUSLY TAKEN CONCERNING
SAID JOINT WATER AND SEWER SYSTEM AND SAID
BONDS; AND PROVIDING THE EFFECTIVE DATE HEREOF.
WHEREAS, the City of Chubbuck (herein "City") in
the County of Bannock and State of Idaho, is a municipal
corporation duly organized and existing as a City under
the general laws of the State of Idaho; and
WHEREAS, the City now owns and operate% and
does hereby determine that it shall continue to own and
operate, a water system; and
WHEREAS, the City is presently without any
sewage collection and treatment facilities; and
WHEREAS, the City does hereby determine that it
shall operate its sewerage system and its water system as
a joint water and sewer system, as a single utility (here-
in sometimes designated as the "system"); and
WHEREAS, the City Council (herein "Council") has
determined and does hereby determine that the interest of
the co~unity and the public interest and necessity require
the construction of a sewerage system and the improvement,
betterment and extenSion of the water system, constituting
together the Joint water and sewer system of the City
(herein the "Project"); and

WHEREAS, for the purpose of defraying in part the
cost of the water and sewer Project, the City Council hereby
deems it necessary to issue its negotiable, coupon general obli-
gation water bonds and sewer bonds in the aggregate principal ame~u t
of $100,000.00, and $80,000.00 respectively, or so much thereof as
may be necessary; and
WHEREAS, for the purpose of defraying a further
part of the cost of acquiring the Project, the Council further
deems it necessary to issue its joint water and sewer revenue
bonds in the aggregate principal amount of $523,500.00, or
so much thereof as may be necessary, payable solely from
the revenues of said system as so improved pursuant to the
Revenue Bond Act cited as Sections 50-1027 through 50-1042,
Idaho Code, and all laws thereunto enabling; and
WHEREAS, the City has heretofore issued its water Water Works System
revenue bonds designated as _~9~%~_~nd ~f 1 q~l dated
the 1st day of july , 19_~ issued in the original
principal amount of $ 70,000.00 of which there are presently
outstanding $ 10,000.00 ; and
WHEREAS, except for the bonds described above,
the City has never pledged the revenues derived from the
operation of the system for the redemption of revenue bonds -
payable from such revenues, or otherWise, with the result
that ~the net revenues to be. derived from the operation of
the system may be pledged lawfully and irrevocably to se-
cure the repayment of said revenue bonds herein authorized
pursuant to the Revenue Bond Act; and
WMEREAS, said revenue bonds shall not be a debt
of the City and it shall not be liable thereon, nor shall
said bonds be payable out of any funds other than the revenue
from said system pledged to the payment thereof; and
WMEREAS, said revenue bonds cannot be issued with-
out the assent of the necessary percentage of the qualified
electors of said City voting at an election held for the
purpose of authorizing or refusing to authorize said liability
or obligation; and
WHEREAS, general obligation bonds cannot be
issued without the assent of the necessary percentage of
the qualified electors within the City voting at an election
called for such purposes; and

WHEREAS, not any of the questions herein set forth nor
any question for a similar purpose, has been defeated at an
election which has been held in the City within six (6)
months of the date of the adoption of this ordinance.
N~4, THEREFOre, BE IT ORDAINED BY THE MAYOR AND
COUNCIL OF TME CITY OF CHUBBUCK, IDAHO:
Section 1. All action heretofore taken (not incon-
sistent with the provisions of this ordinance) by the Council
and the officers of the City, directed toward:
a. The Pro]ebt; and
b. The issuance of general obligation water
bonds and general obligation sewer bonds for the City; and
c. The issuance of joint water and sewer revenue
bonds therefor be, and the same hereby is, ratified, approved
and confirmed including the authorizing of bonds at an election
and the giving of notice thereof.
Section 2. Subject to the assent of the necessary
percentage of the electors voting on each of the questions,
it is hereby ordered that the Project be acquired and con-
structed and that the general obligation water bonds in the
aggregate principal amount of $100,000.00 and the general
obligation sewer bonds in the aggregate principal amount of
$80,000.00, and the joint water and sewer revenue bonds of
the C~ity, in the aggregate principal amount of $523,500.00,
or so much thereof as may be necessary, be issued to defray
in part the cost thereof.
Section 3. Said general obligation water bonds
shall bear interest at a rate or rates not exceeding six per
centum (6%) per annum,, payable semiannually (provided that
the first and last interest coupons may be for a period of
longer or shOrter than six months, but not to exceed one year,
at the discretion of the Council), and bonds shall mature
and be payable upon an annual amortization plan, with the
first annual principal payment maturing and payable within
two years from and after the date of the bonds and the last
annual principal payment maturing and payable during the
thirtieth year from the date of the bonds (provided that the
last maturity shall not exceed thirty years from the date of
the bonds). The various annual maturities shall be, as
nearly as practicable, in such principal amounts as will,
together with the-accruing interest on all outstanding bonds

of such issue, be met and paid by an equal annual tax levy
for the payment of the principal of said bonds and interest
thereon during the term for which such bonds shall be issued;
provided, however, that anything herein to the contrary not-
withstanding the Council, upon its determination that it is
to the best advantage of the City, may issue and sell such
bonds with such annual maturities as it shall determine either
prior to or after the fixing of the interest rates such bonds
will bear, and it shall be permissible for the Council to
issue such bonds in the annual maturities so determined upon
and bearing the rate or rates of interest ascertained upon
the sale of such bonds; all in accordance with provisions
of Section 50-1026 Idaho Code, and the Municipal Bond Law of
Idaho; that said bonds shall be in denominations of $100.00,
or any even multiple thereof not exceeding $5,000.00 (to be
fixed later by ordinance), numbered consecutively, beginning
with the number one, the bonds being payable in numerical
order, the lowest number first; and that such bonds may be
made subject to prior redemption at such time or times, with
or without a premium, and upon such terms and conditions as may
be determined by the Council (in its discretion) in the ordin-
ance authorizing the bonds.
section 4. Said general obligation sewer bonds
shall bear interest at a rate or rates not exceeding six per

Section 5. That for the purpose of providing funds
to pay the interest on said general obligation water bonds
promptly when the same falls due and also a sinking fund for
the payment of said bonds at maturity, there shall be levied
annually upon all of the taxable property in said City, in
addition to all other taxes, a sum sufficient to pay the
interest on said bonds and to provide for the payment of the
principal thereof as they mature, and all such taxes must be
levied, assessed and collected as other taxes until the bonds
so issued are fully paid. The faith and credit and all tax-
able property within the said City are and will continue to
be pledged for the punctual payment of the principal of and
the interest on said bonds. Nothing herein contained shall
be so construed as to prevent the City from applying any
other funds that may be legally available for that purpose
to the payment of said interest and principal, and the levy
or levies herein provided for may thereupon to that extent
be diminished.
Section 6. That for the purpose of providing funds

Section 7. The Project briefly and generally
described shall consist of the improvement, betterment and
extension of the municipal water system, including, without
limitation, the replacement of deteriorated and undersized
lines, and the construction of a municipal sewerage system,
including, without limitation, collection lines, transmission
lines and outfall and trunk lines to the sewage treatment
facility of the City of Pocatello, Idaho.
Section 8. The details of improving and construct-
ing the system are more specifically shown and described in
the preliminary engineering report prepared therefor by
For~gren, Perkins and Associates (herein "Engineer"). For
further details, reference is hereby made to said report,
which is now on file and available for inspection in the office
of t~e Clerk of the City.
Section 9. The cost of the Project, including all
incidental expenses, has been estimated by the Engineer to
be approximately $2,064,500.00. The City contemplates issuing
general obligation water bonds in the aggregate principal
amount of $100,000.00 and general obligation sewer bonds in
the aggregate principal amount of $80,000.00, or so much
thereof as may be necessary. The City also contemplates
issuing revenue bonds in the aggregate principal amount of
$523,500.00 or so much thereof as may be necessary. The
City anticipates that the balance of the cost will be defrayed
by a special assessment district or districts for $332,500.00
and by federal grants of approximately $863,300.00 and a
grant from the State of Idaho in the amount of approximately
$165,200.00. The amounts of these grants may vary from these
estimates depending upon the availability of funds.
Section 10. Such joint water and sewer revenue
bonds shall bear interest at a rate or rates not exceeding

6% per annum, payable annually, or at such lesser intervals
as may hereafter be prescribed by ordinance; shall mature
serially (or in installments if one bond is issued repre-
senting the entire principal amount of the bond issue) com-
mencing 1 year and ending 30 years from the January 1 fol-
lowing delivery; shall be payable solely from the revenues
of the joint water and sewer system; and may be made sub-
ject to prior redemption at such time or times, with or
without a premium, and upon such terms and conditions as
may be determined by the Council in the ordinance author-
izing said bonds.
Section 11. A special municipal bond election be,
and the same hereby is, called to be held on Tuesday, the
~ day of ~, 1971, between the hours of 12:00 o'clock
noon and 8:00 o'clock p.m., on said day, for the purpose of
enabling the qualified electors of said City to vote upon
the questions of issuing general obligation water bonds and
issuing general obligation sewer bonds and of issuing joint
water and sewer revenue bonds set forth in the notice of
election, the form of which is prescribed by this ordinance.
SectiOn 12. There shall be one voting precinct
with bOundaries conterminous with those of the City.
Section 13. At said election the voting place and
officials serving thereat shall be as follows:

Sec~:ion 14. The polls and the ballot boxes shall
open at the hour of 12:00 o'clock noon on said day and shall
remain open continuously until the hour of 8:00 o'clock p.m.
of said day, at which time the polls shall be closed.

Instructions to Voters:
In the case of each of the above questions, the voter
must make a cross (X) in the appropriate space opposite
the words which express his choice.

Section 16. The Clerk shall cause to be printed
not less than 15 days before the election, sample ballots
containing the question to be submitted, which sample bal-
lots shall be in the same form as the official ballots to
be used, except they shall have printed thereon the words
"sample ballot," shall be on paper of a different color than
the official ballot and shall not be numbered, and the Clerk
shall furnish copies of the same on application at her
office, to anyone applying therefor. Said sample ballot
shall be published at least twice in the official newspaper
of the City, the last time to be within 5 days of the elec-
tion.
Section 17. Ballots shall be furnished by the
City Clerk to the judges of the election to be by them
furnished to the voters. At said election only those per-
sons who are qualified to vote, as aforesaid, shall be per-
mitted to vote on said question.
Section 18. That notice of such municipal bond
election shall be given prior to said election by publishing
Idaho State
notice of election in Journal ~ a newspaper published

the City for a period of not less than thirty (30) days by
at l~'ast five insertions at weekly intervals therein, prior

tem and improve, better and extend the water
system, the sewer system and the water system

At such election only registered qualified electors
of the City will be permitted to vote on the question sub-
mitted.
A qualified elector shall be over the age of 21
years, a citizen of the United States, and a resident of the
State of Idaho for the 6 months, and of the City of Chubbuck,
and County of Bannock for the 3 months, immediately pre-
ceding said election.
The polls will o~en at the hour of 12:00 o'clock
noon on said day, and will be open continuously until the
hour of 8:00 o'clock p.m., at' which time the polls will be
closed.
There shall be one voting precinct with boundaries
conterminous with those of the City. The polling place for
the qualified electors and the officials serving thereat
shall be as follows:

Registrar of said City. The place of registration is the
office of the City Clerk at 5160 ~owstona , Chubbuck, Idaho
Except as provided by Section 50-412, Idaho Code,
it shall be necessary to register in order to vote at such
bond election. When once so registered for a general city
election, thereafter an elector shall not be required to
again register for the special bond election so long as he
shall have continued to reside at the same address, or with-
in the same precinct in which he is registered except as
hereinafter provided. If such elector shall have moved to
another precinct within the City, he shall notify said Clerk
of such change of address, and such Clerk shall thereupon
strike the ~ame of such elector from the electors' list in
which he is registered and shall register him in such elec-
tors' register at the new address in the precinct to which
the elector shall have. moved. If an elector shall have
failed or neglected to vote at any general biennial city
election, the Clerk shall strike the name of such elector
from the electors' register, and such elector, in order to
vote at the special bond election, must again register.
Persons who are not currently registered may register on each
day at any time during the office hours of said Clerk until
and including the Saturday next preceding the election; and
on Thursday, Friday and Saturday next preceding the election
persons may resister between the hours of 9:00 o'clock a.m.
and 5:00 o'clock p.m. and between the hours of 7:00 o'clock
p.m. ar~t 9:00 o'clock p.m.
The voting at said election shall be by ballot.
The ballots to be supplied the voters for their use at said
election shall be in the form set out in said Ordinance No.
96 .
Said Ordinance No. 96 was adopted for the
purpose of ordering the construction of a sewerage system
and the imp~ovement, extension and betterment of the muni-
cipa~ water system, and orger~'ng t~e issuance of general
obligation water bonds and general obligation sewer bonds
and of joint water and sewer revenue bonds, subject to the
assent of the necessary percentage of the qualified electors
voting on each of the questions.

Section 19. If at such election the necessary
percentage of the qualified electors of the City voting at
such election assent to the issuance of the general obliga-
tion water bonds or the general obligation sewer bonds or
the joint water and sewer revenue bonds, they shall be sold,
executed and delivered in the same manner provided by the
'%4unicipal Bond Law" of the State of Idaho.
Section 20. The officers of the City be, and they
hereby are, authorized and directed to take all action neces-
sary or appropriate to effectuate the provisions of this
ordinance.
Section 21. All by-laws, resolutions and ordi-
nances in conflict with this ordinance, are hereby repealed.
Section 22. If any section, paragraph, clause or
provision of this ordinance shall for any reason be held to
be invalid or unenforceable, the invalidity or unenforce-
ability of such section, paragraph, clause or provision shall
not affect any of the remaining provisions of this ordinance.
Section 23. This ordinance shall be in full force
and effect from and after its passage, approval and publica-
tion, as provided by law.

upon oath deposes and says:
That the undersigned is now, and at all times here-
inafter mentioned has been, the duly appointed, qualified and
acting City Clerk and ex-officio Registrar of the City of
Chubbuck, County of Bannock and State of Idaho.
That all persons who were not originally correctly
registered for the specia~nicipal bond election held on
Tuesday, the 13thday of ~, 1971, as provided by law,
were permitted to register each day at any time during the
office hours of said Clerk, until and including the S
next precedin~ the election, to-wit, the ... day of~ ,
1971, between the hours of 9:00 o'clock a.m. and 5:00 o'clock
p.m., provided however, that on Thursday, Friday and Saturday
next preceding said election, said persons were permitted to
register at said office between the hours of 9:00 o'clock a.m.
and 5:00 o'clock p.m. and between the hours of 7:00 o'clock
p.m. and 9:00 o'clock p.m.
That any person offering to register was permitted
to register if he was over the age of 21 years, a citizen of
the United States, and a resident of the State of Idaho for
6 months and of Bannock County and of the City of Chubbuck for
3 months immediately preceding said election.
