AND OTHER PLACES BETWEEN CERTAIN HOURS; PROVIDING FOR THE DEFINiTiON OF DUTIES OF PARENTS OR OTHERS iN CARE OF SAiD MI.NORS; PROViDiNG FOR THE ARREST AND PENALTIES FOR VIOLATIONS THEREOF, REPEALING ANY AND ALL PARTS OF ORDINANCES iN CONFLICT THEREWITH; AND PROVIDING FOR THE EFFECTIVE DATE OF TH1S ORDINANCE AFTER iTS APPROVAL.AND PUBLiCATiON ACCORDING TO LAW'. Section 1. ~rnereas, the City Council of the City of Chubbuck determines that it is for the best welfare of the minor aged children regulated by this ordinance and the citizens of Chubbuck that these regulations be placed in full force and effect NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCiL B ' OF THE CITY OF CHUB UCK. Section 2. That the loitering of minors is prohibited and it shall be unlawful for any minor under the age of eighteen (18) years to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public pi. aces and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 12:00 o'clock midnight ii and 6:00 o'clock A.M. of the following day, official city time, :i provided, however, that the provisions of this section do not !apply to a minor accompanied by his or her parent, guardian, or .: other adult person having the care and custody of the minor, or i! where the minor is upon an emergency errand or legitimate ~i business directed by his or her parent, guardian, or other adult !I person having the care and custody of the minor, or a minor who · i is lawfully married or a member of the Armed Forces of the United States of America on active duty. Each violation of the provisions of this section shall constitute a separate offense. .~S..ection 3~. IT iS FURTHER ORDAiNED AND THIS DOES HEREBY ~ORDAiN that it shall be unlawful for the parent, guardian, or other adult person hay:mo the care and custody of a minor under loiter, idle, wander, stroll, or play in or upon the public the age of eighteen (18) years to knowingly permit such minor to streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement or entertainment, vacant lots or other unsupervised places, between the hours of 12:00 o'clock midnight and 6:00 A.M. of the following day, official city time, provided, however, that the provisions of this section do not apply when minor is accompanied by his or her parent, guardian, or other adult per- son having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by hms' or her parent, guardian, or other adult person having the care and custody of the minor. Each violation of the provisions of this section shall constitute a separate offense. ect~.Rn ~. Any minor violating the provisions of Section 2 hereof shall be dealt with in accordance with the Youth Rehabilitation Act of the State of Idaho. Any parent, guardian, or other adult persons having care and custody of a minor violating Section .3 hereof shall be fined not more than Three Hundred Dollars ($.300.00) or confined in ~ail not more than thirty (.30) days, or punished by both said fine and imprisonment for each offense. Section 5. IT iS FURTHER ORDAINED that all existing ordinances of the City of Chubbuck are hereby repealed insofar as they may be inconsistent with the provisions of th±s ordinance, and Ordinance No..31 is expressly repealed in its entirety ~ection 6- BE IT FURTHER ORDAINED that it is the intention of the Mayor and Council of the City of Chubbuck that each separate provision of this ordinance shall be deemed -2- independent of all other provisions herein, and it is further the intention of the City Council that if any provisions of this ordinance be declared invalid, all other provisions thereof shall remain valid and enforceable. Section_ 7. BE IT FURTHER ORDAINED that this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. DONE AND DATED THIS ~ day of ~, 1969.
