HomeMy WebLinkAbout0068 Beer Regulations 1966ORDINANCE NO. ~ ~ AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO AN ORDINANCE PROVIDING FOR THE REPEAL OF SUBDIVISION (C), SECTION 12, AND THE FOLLOWING QUOTED LAST WORDS CON- TAINED IN PARAGRAPH 14 OF ORDINANCE NO. 62 OF THE VILLAGE OF CHUBBUCK, AS THE SAME WAS ADOPTED ON THE llTH DAY OF AUGUST, 1964, TO-WIT: "TO PERMIT CONSUMPTION ON THE PREMISES FROM ONE O'CLOCK A. M., SUNDAY, UNTIL SEVEN O' CLOCK A. M. OF THE FOLLOWING MONDAY." THE PURPOSE OF THIS ORDINANCE BEING, TO PERMIT THE SALE OF BEER UPON LICENSED PREMISES BETWEEN THE HOURS OF SEVEN O'CLOCK A. M. AND SEVEN O'CLOCK P. M. ON SUNDAYS, REPEALING ANY ORDINANCE, OR PART OF ORDINANCES, IN CONFLICT HEREWITH: ENACTING ALL THE REMAINING PARTS OF THE SAID ORDIN- ANCE NO. 62; AND DECLARING AN EMERGENCY. ORDINANCE NO. ~ BE IT ORDAINED By the Chairman and Board of Trustees of the Village of Chubbuck, Bannock County, Idaho: FIRST: That the following set forth portions of Ordinance No. 62 of the Village of Chubbuck, enacted the llth day of August, 1964, be repealed, cancelled, and deleted from the Ordinances of the Village of Chubbuck; said portions of the said Ordinance are as follows, to wit: Subdivision (c) of Section 12 of the said Ordinance, reading as follows: "(c) It shall be deemed unlawful, and the license shall be subject to revocation or suspension as herein provided for, should said licensee sell, dispense, trade, or barter beer for consumption upon the licensed premises, or permit beer to be consumed upon such premises from one o'clock A. M., Sunday, until seven o'clock A. M. of the following Monday. All times mentioned in this Ordinance shall be Mountain Standard Time. Presence of any uncapped or opened beer bottles, containers, cans, or glasses on the premises between the hours of one o'clock A.M., Sunday, and seven o'clock A. M. of the following Non- day shall be prima facie proof of a violation." and the following quoted last words contained in Section 14 of Ordinance No. 62, reading as follows, to-wit: "...and to permit consumption on the premises from one o'clock A. M., Sunday, until seven o'clock A. N. of the following Monday." All Ordinances, and parts of Ordinances, in conflict herewith, are hereby repealed. All other portions of the said Ordinance No. 62 are hereby reaffirmed and re-enacted. That an emergency is hereby declared to exist, and this Ordinance shall take effect, and be in full force and effect, from its passage, approval, and publication as provided by law.
