AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, A ;MUNICIPAL CORPORATION
OF THE STATE GF IDAHO, PROVIDING FOR THE ACCEPTANCE OF AN OFFER
BY THE GOVERNMENT OF THE UNITED STATES TO GRANT FINANCIAL AID
TO THE BANNOCK COUNTY REGIONAL PLANNING COMMISSION IN WHICH.
THE.VILLAGE OF CHUBBUCK IS A PARTICIPATING MEMBER AND PROVIDING
FOR THE VILLAGE OF CHUBBUCK TO ABIDE BY..ALL PROVISIONS, TERMS
AND CONDITIONS OF SAID OFFER: PROVIDING FOR THE GRANTING.OF
AUTHORITY'TO 173E OFFICERS OF SAID PLANNING AGENCY TO DELIVER
CERTIFIED COPIES OF THIS ORDINANCE AND OTHER DOCUMENTS OR
PROOFS REQUIRED TO EFFECT AN ACCEPTANCE OF SAID OFFER AND TO
PERFORM ALL OTHER ACTS AND THINGS REQUIRED TO BE DONE OR
PERFORMED IN ORDER TO OBTAIN SUCH FEDERAL GRANT: PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY
TO EXIST.
WHEREAS, under the Housing Act of 1954, as amended, the
United States of America (herein called the "Government") has
tendered to Bannock.County Regional Planning Commission (herein
called the "Planning Agency ") an offer, hereinafter mentioned,
to make an Urban Planning Agency to aid in financing a project,
designated Project No. Ida. P -1; and
WHEREAS, the governing body of the Village of Chubbuck which
is represented on the Said Bannock County Regional Planning
Commission has given due consideration to said offer and the
terms and provisions thereof,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO:
Section 1. The Offer of the Government to the Planning
Agency dated August 3, 1959, designated Contract No. Ida.
P -1 (G), consisting of Parts I and II, under and subject to
the provisions, terms, and conditions of which the Government
would make a grant to the Planning Agency to aid in financing
the cost of a project, designated Project No. Ida. P -1, situated
in Pocatello Metropolitan Area, Idaho, is hereby in all respects
accepted.
Section 2. The Village of Chubbuck agrees to abide by all
of the provisions, terms, and conditions of said offer.
Section 3. Authority is granted to the officers and duly
appointed agents of the Planning Agency to send to the Housing
and Rome Finance Agency certified copies of this and such
further documents or proofs in connection with the acceptance,
of said Offer as may be requested by the Government, and to
file requisitions, together with necessary supporting documents,
with the Government, from time to time as grant funds are
required, requesting payments to be made to the Planning Agency
on account of the grant provided for in said Offer, and to
do and perform all other things and acts required to be done
or performed in order to obtain such payments.
Section 4. That the Village Clerk of the Village of
Chubbuck shall certify to the adoption of this ordinance and
cause the same to be published.
Section 5. Should any part or parcel of said Ordinance
be declared invalid for any reason, such declaration or
invalidity shall have no effect upon the remaining portion
and sections of said Ordinance.
Section 6. This Ordinance to become effective upon due
passage and publication as provided 'by law and an emergency
existing.
PASSED AND APPROVED this 1,§' day of September, 1959,
at the Village of Chubbuck.
