AN ORDINANCE REPEALING ORDINANCE NUMBER 22 OF
THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO,
PERTAINING TO WATER RATES AND REGULATIONS; AND
AMENDING SECTION 30 OR ORDINANCE NUMBER 18 OF
THE OFFICIAL ORDINANCE OF THE VILLAGE OF CHUB -
BUCK, BANNOCK COUNTY, IDAHO, PERTAINING TO WATER
RATES AND REGULATIONS AND CHANGING THE RATES SET
OUT THEREIN TO CONFORM WITH THE NEW SCHEDULE SET
OUT HEREIN; PROVIDING AN EFFECTIVE DATE FOR THESE
CHANGES AND DESIGNATING THE TIME AND PLACE FOR THE
TAKING EFFECT OF THIS ORDINANCE AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THERE-
WITH, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES
OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO:
Section 1, That Ordinance Number 22 of the Village of
Chubbuck be and the same is hereby repealed and that Section 30
of Ordinance Number 18 of the Village of Chubbuck, Bannock
County, Idaho, be and the same is hereby amended to read as
follows:
Section 30. From and after the lst day of March, 1957,
the following rates of water rentals shall apply and be paid to
the Village of Chubbuck by the users living in the Village of
Chubbuck from the municipal water works of said Village.
For three fourths inch connection and each
1\1 residence occupied by one family only ------------- $4-.50
per month.
For one inch connection for each residence
c ccu ied by one family only 6.00
per month.
For one and one fourth inch connection and
larger for each residence occupied by one
familyonly --------------------------------------- $7.50
per month.
For each unit occupied by more than one family
' there shall be paid the rate set out above re-
lating each residence plus ------------------------ $2.00
a month additional fee for each and every
family occupying said residence.
For apartment houses or dwellings containing
two or more living units or occupied by two
or more families the basic charge set out here-
tofore depending on the size of the pipe con-
nection-for the first living unit or family
occupying the same and ---------------------------- $2.00
additional per month for each additional living
unit or additional family occupying the same.

For motels containing two or more ]Bring units
the basic charge set out heretofore for the
first living unit and ------------------------------ $ .5

not have cooking or house keeping facilities

per month additional for each unit having cook-
ing or house keeping facilities therein.
For trailer courts, there shall be paid by the
owner of such trailer court to the Village of
Chubbuck in addition to basic charge the sum

per month per trailer stall ;oprovided, however,
__that the owner way be granted relief by the
Village Board under proper circumstances as
hereinafter provided for.
The Village Board shall be empowered to grant relief
to any water user where it appears that the charges
made for the use of said water or the services thereon
is grossly unjust. The Village Board may also, at its
option, grant special relief to any subscriber to the
Village water where it is shown that the subscriber
does not have use for the service and that the charges
made to said subscriber are grossly unjust.
For each horse or cow kept on the premises of any
person using Village water there shall be paid the
sum of $.15 per head per month additional to any
other water charges for said premises. The owner
of any cows or horses shall file each month at the
time of paying hiswater assessments a statement as
to the average number of cows and horses he has had
on the premises during the month.

Provided, however, that in no case shall the monthly

Provided further, that where the property is to be
vacant and unoccupied and no water used for a period
of one month or more, the owner may apply to the Village
to have the water shut off, during such vacancy, and
while so shut off from the property, no minimum or
other charge shall be made for water during said period,

but such period of relief from the minimum charge shall
not exceed five months period in any one year, and at
the expiration of any five month period of vacancy or
of unoccupied property where the water is shut off, as
above,-the minimum charge shall begin and be imposed.
Prodded further, that when the water has been turned
off, the applicant for turning it back on shall pay to
the Village the sum of $2.50 as a service charges
The Village of Chubbuck shall

ed rates for all water used for municipal purposes, whic
charges shall be paid to the Village Clerk from the Gen-
eral Fund of the Village to/be thereafter handled in the
same manner as the revenues from regular consumers or
users.
Provided further, that the Village Board may set any
special rate as they may deem to be just and proper

the Village limitsserved with water from the municipal
water works now or hereafter.
Section 2. All ordinances or parts of ordinances insofa
as they are in conflict herewith are hereby repealed.
Section 3. This ordinance shall be in full force and
effect from and after its passage, approval and due publication
as provided by law.
