AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, ANNEXING THE EOLL,OWING- DESCRIBED LANDS, TO -WIT: Beginning at an intersection of the Easterly right -of -way line of the Yellowstone Park Hiway with the South line of the N2SWYNE4, Sec. 10, Twp. 6 S., R. 34 E.B.M., same being a point on the Southerly boundary line of the Village of Chubbuck, Bannock County, Idaho; thence South- erly along the said Easterly right -of -way line of the Yellowstone Park Hiway, 2450.0 feet more or less to a point of curvature; thence South- easterly on'a curve to the left a distance of 1100.0 feet more or less to a point on the Northeasterly right -of -way line of said Hiway that is 66.0 feet more or less due North of an interesection of the South - westerly right -of -way line of said Yellowstone Hiway with the Northerly right -of= -way Line of Quinn Road; thence due South 66.0 feet Mbi6 or less to an intersection of said}Soµthwesterly right -of -way line of the Yellowstone Park Hiway with the Northerly right -of -way line of Quinn Road; thence Westerly -along the Northerly right -of -way line of Quinn Road a distance of 625.0 feet more or less to intersect the Easterly right -of -way line of the Pple Line Road;,thence Northerly along the said Easterly line of Pole Line Road a distance of 617.0 feet more or less to intersect the Southwesterly line of the Yellowstone Park Hiway; thence Southeasterly along the said Southwesterly right -of -way line of the Yellowstone Park Hiway a distance of 873.0 feet more or less to a point that is 5.0 feet at right angles Westerly from an intersection with the Northerly right -of -way line of Quinn Road; thence due North 61.0 feet more or less to a point that is S.O-feet at right angles Southwesterly from the Northeasterly right -of -way line of said Yellow - stone Park Hiway; thence Northwesterly on a line that is 5.0 feet at right angles Southwesterly and parallel to said Northeasterly right - of -way line of the Yellowstone Park Hiway 1095.0 feet more or less to a point that is 5.0 feet at right angles Westerly from the aforemen- tioned point of curvature of said Hiway; thence Northerly on a line that is 5.0 feet Westerly from and parallel to the Easterly'right-of- way line of the Yellowstone Park Hiway a distance of 2450.0 feet more or less to intersect the South line of the NY2SW64NEV44, Sec. 10, Twp.,6 S., R. 34 E.B.M., same being a point on the Southerly boundary line of the Village of Chubbuck; thence Easterly along the said South line of the %SA4M, Sec. 10, a distance of 5.0 feet to the point of beginning. TO THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, AND DECLARING SAID LAND TO BE PART OF SAID VILLAGE: AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, it appears to the Chairman and Board of Trustees of the Village of Chubbuck, that there are certain lands lying adjacent and contiguous to the Village of Chubbuck, Idaho, tracts of land containing not more than five (5) acres each, by metes and bounds descriptions, all being included within the property hereinafter particularly described; AND, WHEREAS, the lands hereinafter described are each and all adjacent and contiguous to the incorporated limits of the Village of Chubbuck, Bannock County, Idaho; AND, WHEREAS, the Chairman and Board of Trustees of the Village of Chubbuck, do at this time, deem it advisable and for the best interest of the in- habitants of the said Village, to annex the hereinafter described lands, and to declare the same to be a part of the Village of Chubbuck, Bannock County, Idaho; NOW, THEREFORE, in consideration of the premises: BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, As follows: SECTION 1. That the following lands, adjacent and contiguous to the Village of Chubbuck, Bannock County, Idaho, respectively be, and the same are hereby annexed to the Village of Chubbuck, under the provisions of Section 50 -303 of the Idaho Code, to -wit: That certain property lying and being in Bannock County, Idaho, described as follows: Beginning at an intersection of the Easterly right -of -way line of the Yellowstone Park Hiway with the South line of the WSWyNE%, Sec. -10, Twp. 6 S., R. 34 E.B.M., same being a point on the Southerly boundary line of the Village of Chubbuck, Bannock County, Idaho; thence Southerly along the said Easterly right -of -way line of the Yellowstone Park Hiway, 2450.0 feet more or less to a point of curvature; thence Southeasterly on a curve to the left a distance of 1100.0 feet more or less to a point on the Northeasterly right -of -way line of said Hiway that is 66.0 feet more or less due North of an intersection of the Southwesterly right -of -way line of said Yellowstone Hiway with the Northerly right- of -wAy line of Quinn Road; thence due South 66.0 feet more or less to an intersection of said Southwesterly right -of -way line of the Yellowstone Park Hiway with the Northerly right -of -way line of Quinn Road; thence Westerly along the Northerly right -of -way line of Quinn Road a distance of 625.0 feet more or less to intersect the Easterly right -of -way line of the Pole Line Road; thence Northerly along the said Easterly line of Pole Line Road a distance of 517.0 feet more or less to intersect the Southwesterly line of the Yellow- stone Park Hiway; thence Southeasterly along the Southwesterly right -of -way line of the Yellowstone Park Hiway a distance of 873.0 feet more or less to a point that is 5.0 feet at right angles Westerly from an intersection with the Northerly right -of -way line of Quinn Road; thence due North 61.0 feet more or less to a point that is 5.0 feet at right angles Southwesterly from the Northeasterly right -of -way line of said Yellowstone Park Hiway; thence Northwesterly on a line that is 5.0 feet at right angles Southwest- erly and parallel to said Northeasterly right -of -way line of the Yellow- stone Park Hiway 1095.0 feet more or less to a point that is 5.0 feet at right angles Westerly from the aforementioned point of curvature of said Hiway; thence Northerly on a line that is 5.0 feet Westerly from and par- allel to the Easterly right -of -way line of the Yellowstone Park Hiway a distance of 2450.0 feet more or less to intersect the South line of the N2SWyNE4, Sec. 10 Twp. 6 S., R. 34 E.B.M., same being a point on the Southerly boundary line of the Village of Chubbuck; thence Easterly along the said South line of the WSWyNEY4, Sec. 10, a distance of 5.0 feet to the point of beginning. and the said lands are hereby declared to be a part of the said Village of Chubbuck, Idaho. SflCTION 2. That it shall be the duty of the Village Clerk of the Village of Chubbuck, immediately after the passage, approval and due publication of this Ord- inance, according to the law, and said Clerk is hereby directed to file with the County Recorder of Bannock County, State of Idaho, a certified copy of this Ordin- ance, duly and properly certified by her, and under the corporate seal of the Village - 2 - of Chubbuck, and immediately thereafter the incorporated limits of the said Village of Chubbuck shall extend to and include the above - described lands, and all of them, and thereafter all property and persons within the limits of the said an- nexed lands shall be subject to all of the provisions of the said Village of Chub - buck, and to the police regulations thereof. SECTION 3. That all Ordinances or Resolutions, or parts thereof, in conflict herewith, be, and the same are hereby expressly repealed. SECTION 4. That this Ordinance shall take effect from and after its passage, approval, and publication, an emergency existing therefor. ATTEST: d PASSED AND APPROVED This (`(i day of , 1953.
