ORDINANCE NO. 6 <br />AN ORDINANCE PROVIDING FOR THE LICENSING OF THE SALE AND DISTRIBUTION OF <br />BEER; PROVIDING AN APPLICATION FORM; PROVIDING THAT A LICENSE BE REQUIRED <br />OF ANY RETAILER; PROVIDING AN ANNUAL LICENSE FEE; PROVIDING CONDITIONS <br />FOR THE ISSUANCE OF A LICENSE; PROVIDING FOR THE REVOCATION OF A LICENSE; <br />AND PROVIDING AN 'EMERGENCY CLAUSE; AND REPEALING ALL OTHER ORDINANCES OR <br />PARTS OF ORDINANCES INSOFAR AS THEY ARE IN CONFLICT WITH THIS ORDINANCE. <br />BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE <br />OF CHUBBUCK, BANNOCK COUNTY, STATE OF IDAHO; <br />SECTION 1. No retailer shall sell, lend, deal in or dispose of, by <br />gift, sale or otherwise, or keep or offer for sale, beer as defined in <br />this Ordinance, within the Village of Chubbuck, without .first hq.ving a <br />license therefor as hereinafter provided. <br />SECTION 2. All applications for license to sell beer as a retailer <br />shall be made on forms to be supplied by the village setting forth the <br />name of the person asking for such license, his age, representations as <br />to his character as may be required, his citizenship, the location which <br />such business is to be carried on, the business in connection with which <br />the proposed licensee will operate, whether the applicant is owner and <br />in <br />operator of said business, time such applicant has been /that business at <br />that place, and such other information as the governing body may require <br />from time to time. <br />SECTION 3. All applications for retailers beer license shall be <br />accompanied by a receipt from the Village Clerk for the required annual <br />fee for the license, and such fee shall be paid into the general fund of <br />the Village; upon rejection of any application for retailers beer license, <br />the Treasurer shall refund the amount. The annual fee for a retailers <br />beer license to sell beer within the Village of Chubbuck, Idaho, shall be <br />425.00. <br />SECTION 4. All licenses granted hereunder shall be granted subject <br />to the following conditions, and all other conditions of this ordinance, <br />and subject to all other ordinances of the Village applicable thereto. <br />No license shall be granted to any person under twenty -one <br />years of age. <br />
