ORDINANCE NO. 257
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
CHUBBUCK CITY ORDINANCE NO. 255 BY MODIFYING THE AMOUNT
OF THE CIVIL PENALTIES IMPOSED FOR VIOLATION OF THE
CITY'S PARKING ORDINANCES; PROVIDING FOR THE
SEVERABILITY OF THE PROVISIONS OF THIS AMENDATORY
ORDINANCE AND THE ORDINANCE AMENDED HEREBY; REPEALING
PRIOR CONFLICTING ORDINANCES AND SPECIFICALLY THOSE
PROVISIONS OF THE ORDINANCE AMENDED WHICH ARE IN
CONFLICT WITH THIS AMENDATORY ORDINANCE; AND PROVIDING
WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Amendment of Ordinance No. 255. Section 6 of
Ordinance No. 255 of the City of Chubbuck, Idaho, passed and
approved on the 12th day of June, 1984 is hereby amended to read
as follows:
SECTION 6: Par~ing Violation Fees. The owner of a
vehicle in or upon which a parking violation notice has been
left or attached by a police officer or parking attendant
employed by the City may avoid being prosecuted for the
violation alleged in such notice by electing to pay to the
City Clerk, as a civil penalty for such violation, a fee of
five ~{J~ dollars ($5.00) i/~g~/~), unless said fee is not
paid within ten (10) days after the issuance of the parking
violation notice, in which event, the fee shall be ~/~
fifteen dollars ($15.00) ~D/$~J- If the owner fails to
respond to a parking violation within thirty (30) days, a
uniform traffic citation shall be issued to the owner of the
vehicle, and the violation shall be treated as a misdemeanor,
as provided in Section 5 of this ordinance.
SECTION 2: Severability. In the event that any provision of
this ordinance is, for any reason, held invalid by a court of
competent jurisdiction, such holding shall not affect the
remaining provisons of this ordinance, or of the ordinance hereby
amended.

SECTION 3: Repeal. Ail provison of the ordinance hereby
amended, or of any other prior ordinance, which are in
irreconcilable conflict with the provisions of this ordinance, are
hereby repealed to the extent of such conflict.
SECTION 4: Effective Date. The rule requiring an ordinance
to be read on three separate days is hereby dispensed with, and
this Ordinance shall become effective upon its approval and
publication as provided by law.

OF CHUBBUCK, IDAHO, this 28th day of August, 1984.
