HomeMy WebLinkAbout0431 Truck Routes 1994CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 4 3 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ENACTING CHAPTER 10.24 TRUCK ROUTES; DEFINING THOSE STREETS NAMELY YELLOWSTONE HIGHWAY AND SIPHON ROAD WITHIN THE CITY UPON WHICH TRUCKS MAY TRAVEL; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Chapter 10.24. The following Chapter 10.24, "Truck Routes", is hereby adopted: Chapter 10.24 TRUCK ROUTES Sections: 10.24.010 Definitions 10.24.020 Applications of regulation. 10.24.030 Truck routes established. 10.24.040 Truck traffic within the city. 10.24.050 Enforcement. 10.24.010 Definitions. For the purposes of this chapter, the following terms, phrases, and their derivations shall have the meaning given in this section: A. ''Deviating truck" is a trick which leaves and departs from a truck route while traveling within the city. B. 'Person" is a person, firm partnership, association, corporation, company or organization of any kind. C. "Truck" is any vehicle designed or operated for the purpose of transportation of property, and whose licensed vehicle weight exceeds twenty-six thousand pounds but does not include a semi -tractor which weighs less than twenty-six thousand pounds and is separated at the time of operation from the trailer. D. "Truck route" is a way over certain streets as designated in this chapter, over and along which trucks coming into and going out of the city must operate. Ordinance - Page 1 dsc chbbckO8.283 E. "Oversized truck or load" is any truck or load on a truck which would be prohibited on the roads of the state by Idaho Code Section 49-1010, or which may only travel on state roads by permit, pursuant to Idaho Code Section 49-1004. F. 'Destination point" is any lawful business premises for the loading or unloading of cargo or the final lawful parking place. 10.24.020 Application of regulation. A. All trucks within the city shall be operated in accordance with the regulations set forth in this chapter. B. Exceptions. This chapter shall not prohibit: 1. Emergency Vehicles. The operation of emergency vehicles upon any street in the city; 2. Public Utility Trucks. The operation of trucks owned or operated by the city, public utilities, any contractor or materialman, while engaged in the repair, maintenance or construction of streets, street improvements or street utilities within the city; 3. Detoured Trucks. The operation of trucks upon any officially established detour; and 4. Residentially parked semi -tractors. The operation of semi -tractors on residential streets solely for the purpose of temporarily parking the tractor portion on private residential property with the permission of the property owner, in compliance with other laws and ordinances, including Section 10.08.020. The engine of such tractors cannot be left running while the tractor is parked. 10.24.030 Truck Routes Established. There is established within the city the following truck routes upon these parts of the named streets lying within the City of Chubbuck: A. Yellowstone Avenue (U.S. Highway 91) B. Siphon Road from Yellowstone West to the city limits. 10.24.040 Truck Traffic Within the City. A. Outside Origin. 1. Outside Destination Point. All trucks entering the city for destination points outside the city shall operate over a designated truck route. 2. Inside Destination Point. All trucks entering the city for a destination point in the city shall proceed only over an established truck route and shall deviate only at the intersection nearest to the destination point. Upon leaving the destination point, the deviating truck shall return to the truck route by the shortest permissible route. Ordinance - Page 2 dsc chbbckO8.283 Ll 1:1 3. Multiple Inside Destination Points. All trucks entering the city for multiple destination points shall proceed only over the established truck routes and shall deviate only at the intersection with the street nearest to the first destination point. Upon leaving the first destination point, the deviating truck shall proceed to other destination points by the shortest route. Upon leaving the last destination point, a deviating truck shall return to the truck route by the shortest route possible. B. Inside Origin. 1. Outside Destination Point. All trucks on a trip originating in the city and traveling in the city for a destination point outside the city, shall proceed by the shortest route to a truck route as established in this chapter. 2. Inside Destination Points. All trucks on a trip originating in the city and traveling in the city for destination points within the city shall proceed to their destination points by the shortest route possible, using truck routes established in this chapter wherever possible. C. Oversized Trucks or Loads. Any truck or load which meets the definition of oversized truck or load as set forth in this chapter, regardless of point of origin or destination, shall be limited to travel on a route specified upon application for a permit as required by Idaho Code or Chapter 15.20 of this Code. 10.24.050 Enforcement. A. Clerk Maintains Maps. Accurate maps setting out truck routes defined in this title or hereafter amended shall be kept on file in the office of the city clerk and shall be available to the public. B. Street Department to Maintain Signs. The street department shall cause all truck routes upon which truck traffic is required to travel to be clearly signposted. C. Weigh In. The chief of police shall have the authority to require any person driving or in control of any commercial vehicle not proceeding in accordance with the regulations in this chapter to proceed to any public or private scale available for the purpose of weighing and determining whether this chapter has been complied with. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
