HomeMy WebLinkAbout0445 Sale of City Property 19950 CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 44 5 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AUTHORIZING THE SALE BY THE CITY OF CHUBBUCK TO THE SHOSHONE- BANNOCK TRIBES TAX COMMISSION, FORT HALL STRUCTURAL FIRE DEPARTMENT TWO USED FIRE TRUCKS AND APPURTENANT EQUIPMENT FOR THE SUM OF THIRTY THOUSAND DOLLARS;REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Pursuant to Idaho Code section 50-1405, the City Council of the City of Chubbuck does approve the transfer of the two fire trucks described below and appurtenant equipment to the Shoshone -Bannock Tribes Tax Commission, Fort Hall Structural Fire Department for the sum to be paid by them of Thirty Thousand Dollars ($30,000), which sum the Council deems adequate consideration for the trucks and equipment and which the Council deems to be for the best interest of the City. 1967 Boardman Fire Truck, Model C08190, Serial Number 228 901 G19 7112, GVM 30,500#, with 70,332 miles along with a Waterous Pump, Model CM, with a Capacity of 1000 gpm. 1968 Ford/FMC Fire Truck Serial number F61 CRC 172 59 with 34,611 miles along with an FMC Beam Pump Model 200 -B -R70, SO # 8313, pump # 143482 Section 2. Said sale is to be made "AS IS" with no express or implied warranties as to the trucks or the equipment. The City officials are authorized to make said exchange upon this ordinance being effective. Ordinance - Page 1 chbbck10.241 T r • ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
